We’ve got the European Union membership status since 2007 and that means, besides obligations (ie to contribute to the EU budget by paying taxes) also many benefits, the main one being access to the European Union’s budget amounts through grants or projects. SOPHRD – NEW Applicants guide – General Conditions 2012, final version has been published

On 16.10.2012, the Managing Authority for the Sectoral Operational Programme for Human Resources Development has published the final version of the Applicants Guide – General Conditions.

This guide contains a series of changes and additions compared to the previous version. Some of the most important elements for you, as potential beneficiaries, are listed below:

  • The authority has set new maximum remuneration levels for internal and external staff of the management team, the implementation team and administrative and auxiliary staff
  • The daily limit that can be reimbursed per expert, cumulated in one or more projects funded by SOPHRD, is 12 hours/day
  • A short-term expert cannot be reinstated in the project, at the end of the initial period, as a short-term expert position with the same responsibilities. A person who has been hired as a short term expert may be rehired in the project as a long-term expert only with a prior notification
  • The minimum score for each criterion of the evaluation grid is amended and the selection scores for cost – effective criterion is increased from 20 to 30 points
  • Letters of communication regarding the results of the evaluation will be transmitted to applicants through the ActionWeb application
  • The budget for the project will be uploaded by the beneficiaries in ActionWeb, in detailed excel format, in addition to the synthetic budget form
  • Help desk type questions related to a specific request for proposals will be addressed in writing to MASOPHRD / OIPOSDRU responsible no later than 15 days before the date scheduled for opening Action Web application.
  • Appeals to rejected funding requests shall be submitted within a maximum of 3 (three) working days after the rejection notification has been received by e-mail.

SOPHRD News! KAI 6.2 release and progress Report of the European Commission audit mission

MASOPHRD published the Draft Guide for Applicants – Specific conditions for grant proposals no.115, related to key area of ​​intervention KAY 6.2 “Improving access and participation of vulnerable groups in the labor market”. The Call for these grant projects is estimated for 2012 by West Regional Intermediate Body SOPHRD. You can send your proposals, suggestions and opinions about improving this document to the e-mail: ghid115@oirposdru-vest.ro or fax number: (+40 256) 499755 before  15.10.2012.

Estimative financial allocation for this call for proposals is 22,283,955.432 RON (equivalent of EUR 5,000,000).

The project lenght may be between 6 and 24 months, and its total eligible value can range between RON equivalent of EUR 50,000 and EUR 500,000. Also, the target group must consist of at least 100 people.

The eligible applicants under this call are local public administration authorities (administrative territorial unit) – General Directorate of Social Assistance and Child Protection (DGASPC), headquartered in West Region.

Also, extremely important for both potential beneficiaries and also for those who are already  implementing projects financed under SOPHRD, on Monday, October 8th, was published the progress Report on funds managed by MASOPHRD issued by the audit mission and required by the European Commission comprising a series of findings as well as measures to be taken regarding the management of such projects. Measures will have a major impact on beneficiaries, as it clarifies a number of assessment tools, reporting, verification and control.

SOPHRD – NEW Draft Applicant guide – General Conditions 2012, published for consultation

On 28.09.2012, the Managing Authority for the Sectoral Operational Programme Human Resources Development has published for consultation a new Draft of the Applicant Guide – General Conditions 2012, including detailed budget outline, for the application. We recommend you that after analyzing the document, in case you have any suggestions or comments to send them to MASOPHRD, at ghidcg2012@fseromania.ro. This guide contains a number of different elements from the previous version. Some of the items listed below:

SOPIEC Operation 1.3.2 – Consulting Support to SMEs – Call extended until November 30, 2012

The Intermediate Body for SMEs announced today the extension of the second call for proposals for SOPIEC, operation 1.3.2 – Support for advice/consultancy services for  SMEs till November 30 at 14:00.

Given that this is the last call for consultancy projects within SOPIEC but also one of the last among all lines of funding in the 2007-2013 period, all micro-enterprises and SMEs who need consulting services for business development (human resources strategies, marketing, business and management plans etc) have to take advantage of this opportunity.

To fit into this category of eligible beneficiaries, you must have between 1 and 249 employees and a turnover below 50 million Euro / total assets not exceeding 43 million Euro.

The maximum amount of financing you can get is 170.000 lei (approx. 38.000 Euro), representing 70% of eligible costs, and up to 20% of revenues for 2011.

Some of the services that can be financed:

  • Strategies for innovative solutions and creation of new products and / or services and technologies
  • Development of business plans, feasibility studies and/ or feasibility studies to implement eco-efficient and competitive technologies and to create competitive products
  • Preparation of studies and management strategies, marketing and/ or financial analysis for implementing a particular project;
  • Strategies for promotion activities for a project;
  • Strategies and development plans related to human resources in order to stimulate business expansion or implementation of a particular project;
  • Development of studies on intellectual property protection;
  • Comparative studies for the use of tools and solutions or for a specified area;
  • Development of evaluation and diagnostic studies for transfer business.

Practical advices for companies that want to implement projects with EU funding

In clipa de fata, demararea si implementarea cu succes a proiectelor finantate din fonduri europene, este o adevarata provocare pentru multe companii, iata de ce ne-am propus sa acordam atentia cuvenita acestui subiect in randurile care urmeaza.

Dupa un efort sustinut al consultantului si al beneficiarului pentru scrierea si depunerea proiectului in timp util, dupa emotiile si perioada lunga de asteptare a rezultatelor si euforia aflarii vestii ca proiectul a fost aprobat, dupa inca 2-3 luni necesare contractarii, intr-un final, contractul de finantare este semnat! Desi companiile ar putea crede ca acum urmeaza un moment de relaxare bine meritata, de fapt din acest moment incepe adevarata provocare si etapa cea mai dificila pentru beneficiarul finantarii – implementarea proiectului, punerea in aplicare a planului scris.

Fiind un subiect arzator in perioada actuala in domeniul proiectelor finantate cu fonduri europene, ne-am propus sa prezentam cateva situatii dificile cu care se confrunta beneficarii in etapa de demarare a proiectelor si cateva recomandari pentru o implementare eficienta a acestora si pentru a reduce eventualele riscuri majore ce pot aparea, precum nerecuperarea sumelor cheltuite sau chiar rezilierea contractelor de finantare.

• Evitati amanarea si intarzierile prelungite in demararea activitatilor proiectului !

Din experienta noastra, in multe situatii companiile beneficiare au tendinta de a se relaxa dupa semnarea contractului de finantare cu autoritatile si de a amana inceperea efectiva a activitatilor prevazute in proiect, gandind ca exista timp suficient pentru implementarea proiectului. Un alt motiv des intalnit pentru demararea intarziata: beneficiarul nu stie exact cu ce trebuie sa inceapa, ce anume trebuie sa faca mai intai pentru demararea proiectului ! Am avut cateva situatii in care companiile au realizat abia in luna a 2 a sau a 3 a dupa semnarea contractului ca nu initiasera nici o activitate prevazuta in proiect in toata aceasta perioada, desi planul prevedea acest lucru!

De retinut ca din punct de vedere contractual, in functie de Programul Operational in cadrul caruia este finantat, proiectul poate incepe in ziua imediat urmatoare semnarii contractului. De cele mai multe ori, in primele 2-3 luni, planul de activitati cuprinde deja o multitudine de actiuni foarte importante (mobilizarea echipei de proiect , inceperea procedurilor de achizitii, solicitarea pre-finantarii etc) a caror intarziere pune in pericol derularea corecta a intregului proiect. In unele situatii, fara o notificare corespunzatoare a autoritatilor privind anumite intarzieri aparute, compania se poate afla chiar in situatia de a pierde finantarea, prin rezilierea contractului.

Situatii frecvent intalnite si riscuri asociate in primele luni de implementare:

• Beneficiarul nu transmite la timp catre autoritatea finantatoare primele notificari obligatorii.

• Nu sunt respectate termenele de desfasurare a activitatilor, asa cum sunt ele prevazute in calendarul atasat contractului de finantare. In acest caz, fara o notificare a autoritatii si o solicitare a aprobarii replanificarii, exista riscul major de reziliere a contractului si de pierdere a finantarii.

• Nu este respectat termenul de solicitare a prefinantarii sau de depunere a cererilor de rambursare, caz in care este necesara o instiintare a autoritatii si modificarea contractului de finantare, prin incheierea unui act aditional.

De aceea, pentru demararea si implementarea cu succes a proiectelor, recomandam :

• Inceperea imediata a activitatilor, respectand planul de implementare.

• Stabilirea unei liste cu primele actiuni concrete si primele notificari ce trebuie transmise in scris catre autoritate (ce ? cine ? cand ?).

• Intalnirea echipei interne de implementare a proiectului (la care sa participe si expertii si consultantii externi) si discutarea planului de implementare, a actiunilor concrete si a rolului fiecarui membru din proiect. Este momentul in care toti membrii echipei de proiect trebuie sa se familiarizeze si sa inteleaga cat mai bine continutul proiectului. Nu putem vorbi de o implementare de succes, daca echipa interna nu cunoaste exact ce se doreste a se realiza prin proiect si care sunt activitatile care urmeaza a fi implementate, astfel incat sa se poata urmari in fiecare moment unde se situeaza progresul activitatilor fata de graficul initial si evident, in cazul aparitiei unor deviatii, sa poata fi propuse solutii concrete de redresare.

• Atentie la solicitarea prefinantarii !

Cele mai multe companii au prevazut in cererea de finantare solicitarea unei prefinantari, pentru a-si asigura inca de la inceput numerarul necesar demararii proiectului. Ceea ce omit acestea de cele mai multe ori, este ca in cazul proiectelor de investitii (in cadrul POSCCE de exemplu), pentru solicitarea prefinantarii trebuie sa prezinte cel putin un contract cu un furnizor, de o valoare minima, prevazuta in contract (de exemplu minim 5% din valoarea eligibila a proiectului, pentru companii mari).

Asa cum mentionam anterior, am intalnit de-a lungul timpului multe situatii in care, desi prefinantarea era prevazuta a se solicita in primele luni ale proiectului (luna 2 / luna 3), companiile nu au respectat acest termen si au amanat solicitarea acesteia, din diverse motive. Cel mai intalnit motiv a fost imposibilitatea beneficiarului de a finaliza prima procedura de achizitie prevazuta in proiect si implicit, incapacitatea de a prezenta autoritatii un contract in baza caruia sa ii poata fi acordata prefinantarea. Aceasta situatie poate fi evitata, prin analiza calendarului de activitati inca din prima etapa a proiectului, operarea de modificari daca este cazul si devansarea acelor achizitii care se pot realiza mai rapid (de exemplu, pentru incheierea de contracte cu furnizori de echipamente), astfel incat in termenul planificat pentru prefinantare sa poata fi incheiat cel putin un contract de achizitie.

In cazul in care societatea este totusi in situatia de a nu-si putea respecta termenul de solicitare al prefinantarii, asa cum mentionam mai sus, ea poate modifica acest termen, prin intocmirea unui act aditional la contractul de finantare.

• Pot exista diferente semnificative intre ceea ce se putea cumpara cu banii solicitati prin proiect la momentul aplicatiei si ceea ce se poate cumpara cu aceiasi suma in momentul implementarii !

Am constatat ca exista situatii (si nu putine la numar) in care bugetul prevazut la momentul scrierii aplicatiei (si evident aprobat de Autoritate), nu mai asigura o acoperire corespunzatoare a cheltuielilor necesare pentru achizitionarea de echipamente sau altor cheltuieli prevazute in proiect. Cel mai adesea, problema este generata de diferenta de curs valutar, care inregistreaza modificari semnificative pe parcursul unui an de zile (perioada orientativa pentru evaluare si contractare). In plus, firmele beneficiare pot constata ca dupa un an, nivelul preturilor pentru echipamentele bugetate este si el mai ridicat fata de ofertele primite cu un an in urma.

Ce solutii exista pentru diminuarea acestui risc :

• Anumite masuri se pot lua la momentul scrierii aplicatiei , existand o linie in cadrul bugetului in care pot fi prevazute rezerve pentru acoperirea eventualelor diferente de curs valutar (din pacate, sunt aplicanti care nu considera oportuna sau neglijeaza utilizarea acestei facilitati in momentul scrierii aplicatiei).

• Dupa semnarea contractului de finantare, pe parcursul implementarii proiectului, exista posibilitatea operarii de modificari in structura cheltuilelilor eligibile, fiind permisa realocarea financiara atat intre liniile bugetare ale proiectului, in limita a maxim 10% din suma inscrisa initial, cat si in interiorul unei linii bugetare.

• Atentie la modificarile permise si nepermise fata de structura proiectului aprobat

Nu sunt permise : modificari substantiale ale proiectului ; incalcarea obligatiei privind mentinerea investitiei pe o perioada de min 5 ani ; nerealizarea indicatorilor .

• Sunt permise pe baza de notificare: modificarea calendarului de activitati, in cazul in care nu se modifica termenul final de finalizare al proiectului si termenul la care vor fi depuse cererile de rambursare ; modificarea sumelor aferente cererilor de rambursare in cazul in care nu se modifica termenele de depunere a cererilor de rambursare.

• Sunt permise pe baza de act aditional la contract: modificarea calendarului de implementare , cu prelungirea termenului de finalizare a proiectului, in limita a 24 de luni (pentru proiecte poscce 1.1); modificarea termenelor de depunere a cererilor de rambursare– in acest caz sunt permise maxim 3 modificari pe toata perioada de implementare a proiectului; modificarea termenului de solicitare a prefinantarii.

In final, incheiem cu 3 recomandari pe care le consideram esentiale si pe care le facem tuturor clientilor nostri :

1. Alocati timp suficient la demararea implementarii proiectului, pentru a planifica corect resursele si activitatile proiectului. De multe ori este necesara o reevaluare si o modificare a planului initial. Insa o planificare buna in acest moment inseamna o implementare ulterioara fara probleme, mai putina bataie de cap din cauza birocratiei (orice schimbare necesita documente si justificari catre autoritate) si un risc redus de pierdere a finantarii.

2. Aveti in vedere ca sunteti un beneficiar de fonduri europene si de aceea, tot ce cumparati de la furnizori prin proiect se poate face numai prin proceduri de achizitii publice, in conformitate cu instructiunile aplicabile; orice greseala inseamna corectii financiare (in termeni mai putin tehnici, bani pierduti)

3. Implicati in implementare resurse umane competente, specializate in management de proiect, de preferabil consultanti cu experienta practica si referinte solide, care nu doar pot preveni riscuri de pierdere partiala sau totala a finantarii, ci va vor usura munca si va vor permite sa va concentrati pe devoltarea business-ului .

NEW State aid scheme for new investments, including companies in the services sector

We would like to inform you that the Romanian Government has published a new state aid scheme to support investments that promote regional development by using new technologies and creating jobs.

The period of project submission and signature of grant agreements is 2 years: 2012-2013, and state aid payment is made by 2018.

The total amount allocated for this scheme is the equivalent in lei of 100 million euros. 

The maximum aid granted for a project is the equivalent in lei of 28.125 million euros (22.5 million euros for Bucharest – Ilfov) and financing is up to 50% (40% for Bucharest-Ilfov) of the wage costs with newly employed staff over a period of 2 years. 

This scheme finances initial investments that include a 20% component of ITC and create at least 200 jobs in the following sectors:

• Manufacturing

• Production and supply of electricity, gas, water, steam and air conditioning

• Software editing activities

• Telecommunications

• Information technology services activities

• Research and development

Public Private Partnership – An opportunity for private investors

On June 27th, VAPRO Romania has participated in the seminar „Public Private Partnership for infrastructure projects” organized by Bursa Media Group – an initiative which we welcome as being still of great interest and current.  

The reason we are saying this is because we have been talking about Public Private Partnership (PPP) for some years now, but it is known that up to today we have no projects implemented or even submitted and approved. However, this is an approach that works well in many other countries (the most representative of them would be Great Britain, France, Hungary, Austria and many more) and which could also work in our country.

So, we will make a short summary, with the main ideas about what PPP means and conclude with some types of projects or priorities brought at the panel by the representatives of the Ministries. We tried to focus on the priority areas that are most interesting for the community of investors, namely: infrastructure – transport and health.  

The PPP is always initiated by a public partner (central or local authority) and is (or should represent) the most appropriate form of raising and involving private capital in the development and operation of public investments. The cooperation between the public and private investors, within a PPP project can run for a relatively long period of time (up to 49 years). In Romania, the authority responsible for the PPP is The Central Unit for Coordination of Public Private Partnership (UCCPPP). Basically, their role is to review the procedural aspects related to the process of selecting the private partner.

What is the procedure and what are the steps of a PPP project?

1. Identifying the object (the need) of the PPP project and approving its opportunity
2
. Developing the pre-feasibility study or background study, and get the approval of the UCCPPP
3. Developing and publishing of the selection announcement for the PPP (description of the project and services needed, the requirements, criteria and methods of evaluation and selection of interested investors)
4. Receiving the letters of intent, from private investors, selecting and signing the project agreement – in order to start the negotiations
5. Negotiation / competitive dialogue and presenting the final offers
6. Designating the winning offers, signing the PPP contract with the private partner selected and publishing the contract
7. Setting up the project company (joint-stock company, Romanian legal entity, having as shareholders the public and private party, who are represented in proportion to their participation in the PPP project)
8. Developing and operating the investment, according to the PPP contract
9.  Terminating the PPP contract by the free transfer of property to the public partner, in good condition, exploitable and free of any charges, and then dissolving the project company

 

Among the most interesting projects, listed as a priority by the ministries,  we mention:       

• Ministry of Transport: Danube – Bucharest channel (Trans-European Transport Corridor VII), estimated value of investment 1.528 million Euro; Highway Tg Mures – Iasi – Ungheni, 307 km, estimated value of investment 609 million Euros; Metro line Bragadiru – Voluntari, 25,9 km, estimated value 2.000 million Euros
•  Ministry of Health: 6 projects for construction and equipment of emergency regional hospitals approved by memorandum in Cluj, Iasi, Tirgu Mures, Timisoara, Bucharest, Craiova, reabilitation of nursing homes/spas from Mangalia, Techirghiol, Felix, etc.

UCCPPP representatives have presented a PPP project, which seems to be the most advanced among the others, project already approved by UCCPPP under the pre-feasibility study phase, namely: building a road tunnel undercrossing Gutai Mountains, with user fees, project innitiated by Maramures County Council. The estimated value of the investment is 92,193,690 euros. The next phases are:  the publication of the announcement in SEAP, negotiating with the private investors and awarding the contract.

Could this be the first PPP project that will attract the interest of private investors for such projects? It should be noted that although there is a legal framework and in the opinion of the legal authorities this could work and could provide the necessary conditions to implement these PPP projects, until now, the investors have not rushed to answer the challenges.

Remains interesting to see if, the current legislation – which according to some is quite restrictive and much more perfectible in the opinion of others – allows the configuration of an optimal mechanism that provides the private investor with the tools to safely return his investment and to obtain an attractive and reasonable profit. The political factor must also be considered. Good news is that, at the European Union level, there are discussions that for the next programming period, 2014 – 2020, in which Romania will spend again a semnificant part of the European budget, we could use the European funds to support PPP projects. Could this be another way to reduce investors’ risks and make these projects more attractive?

SOPIEC 4.1 – Call for proposals – energetic efficiency

Dear Partners,

The Ministry of Economy, Trade and Business Environment, through the  Intermediate Body for Energy, announces the call for proposals for projects that target investments for increasing the energy efficiency, inside operation 4.1, which are co-financed by structural funds.

Total budget for this call is 240 million lei and the maximum amount of funding for a project is 80 million lei (approximately EUR 18.5 million) which can represent up to 70% of the eligible project.

The winning projects can benefit from a pre-financing of up to 35% of the total grant.

Potential beneficiaries are SME’s and large enterprises that carry out economic activities in the extractive industry or manufacturing.

What can be financed:

  • Specific equipment for  enterprises active   in industrial sector, in order to obtain energy savings based on energy  balance (eg, air compressors, pumps, machinery / equipment / ventilation   systems, heating / cooling, boilers, burners, heat exchangers, frequency converters,      integrated energy management and others);
  • High efficiency Cogeneration   units  of industrial enterprises (Cogeneration plants upgrading or building new  ones);
  • Constructions related to  industrial processes of energy efficiency.

The period for submitting the applications is June 15 to October 30, 2012.
